Legal Senior Associate for Contract Review Office

Job Description

The Legal Senior Associate for Contract Review Unit will report and support and be supervised by the Senior Counsel for the Contract Review Unit in all legal aspects in connection with the Oversight Board’s review of government contracts pursuant to Section 204(b)(2) of PROMESA, to ensure that proposed contracts and amendments promote market competition and are not inconsistent with the applicable fiscal plan. “Market competition” review includes oversight of all legal aspects of the governmental procurement process, from RFP design and implementation by targeted governmental agencies to a thorough evaluation of proposals and monitoring of procurement process to final award terms and conditions by such targeted agencies emphasizing transparency. Must be capable of interacting with high-level Government representatives on sensitive, complex, and high-value proposed contracts and procurement activities. 

Essential Role and Responsibilities

  • Review proposed contracts and amendments prior to execution in accordance with Section 204(b)(2) of PROMESA, to ensure that they promote market competition and are not inconsistent with the applicable fiscal plan.
  • Write extensively in English.
  • Interact with internal FOMB teams to evaluate whether proposed contracts and amendments are budgetary compliant.
  • Ability to work under time-sensitive deadlines.
  • Strong organizational skills in managing large amounts of documentation.
  • Maintain current knowledge of changes in laws and/or regulations concerning government procurement.
  • Perform legal research involving procurement and contracting issues.
  • Knowledge of governmental contracting and competitive procurement processes.
  • Monitor governmental procurement process to identify areas of improvement.
  • Duties include interaction with government officials related to proposed contracts and amendments under review and procurement processes.
  • Develop and prepare legal opinions and memoranda for Senior Officials as requested.
  • Apply effective risk management techniques and offer proactive advice on possible legal issues.
  • Communicate consistently with team members during the contract review process to identify areas for operational efficiencies.
  • Prepare Power Point presentations of contracts under review
  • Perform other tasks as requested by the Executive Director,  General Counsel or Contract Review Senior Counsel
  • Daily contact with the Directors, Managers, and staff to achieve the objectives of PROMESA

Frequent contact with consultants, government agencies, attorneys and other stakeholders as needed.

Supervisory responsibilities

The position does not involve supervisory responsibility.

Requirements for the position

Education and Experience

  • Juris Doctorate degree from an accredited law school with up-to-date and current license to practice law
  • Experienced in government contracting  and procurement best practices.
  • Excellent knowledge and understanding of governmental practice and procedures
  • Strong writing skills
  • Strong commitment to detail, successful prioritization and time management skills; works with a sense of urgency to meet deadlines

  • Must have an analytical understanding of PROMESA
